Agreement to terms
Welcome to the Govt.nz app (“App”, “we”, “our”, “us”). By downloading, installing, or using the App on iOS or Android devices, you agree to these Terms and Conditions (“Terms”). Please read them carefully.
This agreement applies to your use of and access to the App and the data and information it contains or provides. The App is created and developed by the New Zealand Government, acting through the Department of Internal Affairs (DIA), Digital Services.
1. Eligibility
1.1 You must be at least 13 years old to use the App.
1.2 By using the App, you confirm that you meet this requirement and that you have legal capacity to enter into this agreement under New Zealand law.
1.3 You represent and warrant that you are the owner or authorised user of any device on which you install or use the App, and that you have the authority to agree to these Terms.
2. Access, wallet and credentials
2.1 General access — you do not need to create an account to access and use the App. Some information and services are available without authentication.
2.2 Wallet setup and security:
- To use the App’s digital wallet, you must set it up on your device.
- The wallet is secured using your device’s authentication methods (PIN, fingerprint or facial recognition).
- The App does not store or transmit your biometric data. Authentication is managed by your device’s operating system.
2.3 Use of credentials:
- The wallet allows you to store accredited digital credentials (such as licences, IDs or qualifications) issued by authorised agencies.
- The App does not issue credentials and does not hold identifying information. Issuing agencies remain responsible for their data.
- You control when and how your credentials are shared. The App never shares credentials without your consent.
- When you present a credential, you consent to share its information with the third party viewing it.
2.4 Responsibilities:
- You are responsible for keeping your device and wallet secure.
- If your device is lost, stolen or compromised, you must take steps to protect your information (for example, lock or wipe your device, re-establish your wallet).
- You must not misuse credentials, attempt to tamper with them, or use them for fraudulent purposes.
3. Using the App and digital identity credentials
3.1 The App enables you to display digital forms of identity credentials. Such as licences, permits or registrations (‘Digital Credentials’) issued by DIA, other government agencies or accredited third parties (‘Issuing Agencies’).
3.2 Some credentials may appear automatically, others require you to set them up and accept terms from the relevant agency.
3.3 You are responsible for:
- Ensuring your device is operational, has a functional screen and is sufficiently charged.
- Checking your Digital Credentials are correct.
- Knowing whether a Digital Credential satisfies a legal requirement to carry or present a document.
- Carrying a physical copy where legally required (for example, drivers licence overseas).
3.4 The App may not be accepted everywhere. Using expired, false or misleading credentials may result in penalties. Offline display is permitted but may be limited.
3.5 Your use of credentials is subject to relevant laws and any Issuing Agency terms or privacy policies.
4. General use and restrictions
You are responsible for your device, internet connection and any related costs.
You must not:
- Modify, copy, reverse-engineer or create derivative works of the App.
- Attempt unauthorised access to DIA, vendor or Issuing Agency systems.
- Resell, transfer or sublicense the App.
- Interfere with the operation, security or performance of the App.
- Use unauthorised third-party software to intercept data.
- Use the App for unlawful, fraudulent, harmful or offensive purposes.
5. User content
5.1 If you submit, upload or share content through the App, you:
- Retain ownership of your content.
- Grant us and relevant Issuing Agencies a limited licence to use and display it to provide services.
- Must not submit, unlawful, harmful, misleading or infringing content.
5.2 We may remove content that breaches these Terms or NZ law.
5.3 Feedback, suggestions or complaints may be used freely by DIA and vendors.
6. Intellectual property
The App is owned by DIA and its vendors or licensors.
You are granted a limited licence to download and use the App on your device in line with these Terms.
You must not use DIA, Issuing Agency or vendor trade marks without permission.
7. Updates, availability and support
DIA may update these Terms, issue mandatory updates, suspend or modify the App.
The App may be unavailable during maintenance or outages.
Support is provided for the current and 2 previous major versions of iOS and Android.
8. Disclaimers
The App is provided on an ‘as is’ basis.
DIA, Issuing Agencies and vendors do not warrant uninterrupted service or universal legal acceptance of digital credentials.
Nothing in these Terms limits your rights under the Consumer Guarantees Act or Fair Trading Act .
9. Limitation of liability and indemnity
To the fullest extent permitted by law, DIA, vendors and Issuing Agencies disclaim liability for losses arising from your use or inability to use the App.
You agree to indemnify DIA, vendors and Issuing Agencies for claims arising from misuse, breach or unlawful activity.
10. Termination
DIA may suspend, restrict or terminate your access at any time for breach or misuse.
You may stop using the App and delete it at any time.
Clauses on intellectual property, disclaimers and liability still apply after termination.
11. Governing law
These Terms are governed by New Zealand law. You submit to the jurisdiction of the New Zealand courts.
12. Third-party terms
If you get the App via the App Store or Google Play, their terms also apply. Apple and Google may enforce these terms as third-party beneficiaries.
13. Notifications and data
DIA and Issuing Agencies may deliver push notifications for surveys, reminders or updates.
The App may send anonymised error and performance data to DIA and vendors.
